“They just don’t get it.” Yes, the phrase is overused, yet, all too appropriate when addressing the continuing critiques, from both the left and the right, of Bill Ayers.

The recent publication of the second phase of his memoir, Public Enemy: Confessions of An American Dissident (Beacon, 2013), was followed on the “SDS and ‘60s Leftists” page of Facebook by an unthoughtful conversation on Ayers, his comrade and wife Bernardine Dohrn, and the Weather Underground (WO).

Facilitated by George Fish and responding to a negative book review by Jon Wiener, 43 comments followed Fish’s post. Mostly sour, bitter, and ahistorical in tone, the comments provide the antithesis of Ayers’ book and life, that of learning from the past and continuing, in a human and life-affirming way, the ongoing struggle that began for Ayers in the civil rights movement, antiwar movement, Students for a Democratic Society, and then the Weather Underground.

When confronted by a radio interviewer who referred to the subtitle as snide, Ayers softly replied that the entire title was chosen for its irony. Missing both the breadth and depth of Public Enemy, the interviewer, as well as Wiener and other critics, fail to acknowledge the thoughtfulness and energy that Ayers brings to struggle, both past and present.

In this particular book, we alternate between the author’s recollections of first, his experience in the 2008 attempt to demonize Barack Obama because he “palled around with terrorists,” and, second, the years after he surfaced from underground beginning in 1980 from where Ayers left off in his previous book, Fugitive Days.

There are both multiple and complex events, issues, and ideas presented in Public Enemy. A sampling will be discussed in this review.

Recently, South African anti-apartheid struggle leader and Constitutional Court Justice (comparable to the U.S. Supreme Court) Albie Sachs spoke at Pacific University in Forest Grove, Oregon. Talking about his country’s Truth and Reconciliation Commission (TRC), Sachs emphasized the importance of acknowledgement for both personal and political healing.

Acknowledgement causes me to return to the radio interviewer’s portrayal of Confessions of An American Dissident as snide. In fact, irony aside, Ayers responded by talking about acknowledging one particular flaw during his time in WO. He asserted that neither he nor his comrades ever doubted their positions and that by not being skeptical they were arrogant and without reflection.

Not only did I never kill or injure anyone, but in the six years of its existence, the Weather Underground never killed or injured anyone either. We crossed lines of legality to be sure, of propriety, and perhaps even of common sense, but it was restrained, and those are the simple, straightforward facts.
The correct term for Weather Underground bombings, in correspondence to the armed struggle in South Africa, is “armed propaganda.” And like Umkhonto We Sizwe underground soldiers in South Africa, Ayers would welcome the opportunity to answer queries about his WO activities at an American TRC.

In Public Enemy Ayers writes:
America, it seemed to me, was in urgent need of some kind of truth and reconciliation process… We needed a process to understand the truth of the past in order to create the possibility of a more balanced future… Everyone together would have the opportunity to tell their stories of suffering, and the victimizers would be asked why and how they created that misery. Society would have the opportunity to witness all of it in order to understand the extent and depth of the disaster as a step toward putting it behind us and moving forward. In that setting and standing with Kissinger and McCain, McNamara and Kerry, Bush and Cheney, I’d be happy to say exactly what I did, take full responsibility, and bow deeply. But without any chain of culpability whatsoever, I’ll stand on the record, or just stand aside.
While five chapters in Public Enemy present the threats and blacklisting Bill Ayers experienced during and after the 2008 presidential campaign, I will address the topic with brevity as it has already been explored in other reviews. An in-depth description and analysis is portrayed in Maya Schwenwar’s Truthout review, “Bill Ayers Weighs in on Democracy, Selfhood, and His ‘Unrepentant Terrorist’ Alter-Ego.”

Besides endless email threats and having someone actually come to his office at the University of Illinois-Chicago, Ayers was banned from talking on college campuses throughout the country. At the time my colleague at the University of South Carolina, Craig Kridel, the Curator of the Museum of Education, posted a page titled “The Bill Ayers Problem” on the Museum webpage. The page title, like Public Enemy, is ironic and at the time I wrote:
The inequality, unfairness, violence, and global greed are what Bill Ayers has fought against for many years. The fight is every bit as important today as it was during the Civil Rights Movement and the Viet Nam War. And while some people might call me insensitive because I refuse to enter a debate on Bill Ayers as a terrorist, I choose not to speak back to the cries of O’Reilly, Hannity, and Colmes and their nameless comrades because the work Bill Ayers is doing does not need defenders but, rather, supporters and allies that fight for a more just world. Finally, as an academic who works with teachers who fought against apartheid in South Africa, I can’t help but think that the same people who define Bill Ayers as a terrorist would have given that label to Nelson Mandela and his less known comrades during the struggle against the apartheid regime. We know now what history says about that – we can only hope that Bill Ayers and many other people continue their work as progressive educators and activists.
But Bill Ayers does not rail against his detractors in his writing. Rather, while he is critical in a political/personal way of their harassment and silencing and analyzes their actions, his emphasis is a celebration of people who continue the struggle. While the story of the cancellation of his talk at the University of Wyoming is politically important, from Ayers we learn more about the woman who fought for his right to speak. More accurately, she fought for her own free speech.
"I’m going to sue the university in federal court," she told me during our first conversation. "And I’m claiming that it’s my free speech that’s been violated – I have the right to speak to anyone I want to, and right now I want to speak to you." She was young and unafraid, smart and sassy, her dreams being rapidly made and used – no fear, no regret. I liked her immediately. Meg’s approach struck me as quite brilliant – students (and not I) were indeed the injured party.
The University of Wyoming student won the case and Bill Ayers spoke on democracy and education with over 1,000 people at the University. In discussing the event, he also honors his sister’s father-in-law, a retired United Church of Christ minister who drove a couple of hours to Laramie for the talk and told Bill: “‘The Lord moves in mysterious ways,’ he said with a wink and a smile gesturing with his Bible. ‘If any of the crazy Christians get out of hand, he wants me to set them straight.’”

Ayers writes of other cancellations at places throughout the country. The University of Nebraska stands out but only because he was in Tapai at the time and was woken with the news from a dean at three in the morning.

In contrast to Nebraska, there are brave academics at Millersville University and Georgia Southern University where Ayers was welcomed. At Millersville administrators explained that it was their “duty and honor” to have him speak. “It’s not about you personally, it’s about the mission and the meaning of the university.”

One of the funniest yet potent tales is the reaction of Ayers’ comrade and friend, Michael Klonsky, when he was invited to give an education conference keynote address. The organization told Klonsky that they had intended to invite Bill Ayers but that he was “too controversial and too radical.” Klonsky scolded the inviter saying: “How dare you ask me to scab on Bill Ayers?” When Ayers thanked him, he replied: “Defending you? I wasn’t defending you, I was defending myself – I was deeply and personally offended when they said that your were too radical, and by implication that I wasn’t too radical. I’m as radical as you are, motherfucker.”

Bill Ayers’ book is about issues, ideas, actions, and people – it is not solely about Bill Ayers. Epsie Reyes was a colleague at the University of Illinois-Chicago. She supported Hillary, not Barack, in the 2008 democratic primaries, and she was one of many people who consoled Bill Ayers after Hillary Clinton first demonized him in a primary presidential debate.

Reyes sent strong emails to both Clinton and the Democratic National Committee “detailing how much money she’d donated and how many weekends she’d devoted to organizing on her behalf, explaining who I really was in her ‘humble opinion,’ and encouraging, then demanding that the campaign apologize to me personally and denounce the smears – or else she would have to rethink her commitments.”

Close friends and colleagues, of course, also came through in both 2001 and 2008. Mona and Rashid Khalidi were both supportive and insightful as were dozens of others. In 2008 there was a surprise call from Edward Said: “Of course it’s painful for you personally, but cringing and going quiet is the worst thing you could do at this moment. Your kids are watching you and your students too and a lot of others. Don’t let them down.”

Said’s message corresponds to the entirety of Public Enemy. Ayers celebrates political struggle and the people who try to sustain the fight. Two quotes come to mind, the first from a speech by Paul Potter referred to in the book. “Don’t let your life make a mockery of your values.” Margaret Meade’s words correspond to Potter’s connecting the personal to the collective. “Never doubt that a small group of thoughtful, committed citizens can change the world. Indeed, it’s the only thing that ever has.”

In addition to the 2001, 2008, and more recent stories, Public Enemy includes portraits from the time Bernardine and Bill came up from underground in 1980. Ayers writes admiringly about his childrens’ pre-school teacher at the time, BJ, whom he refers to as “an inspired early childhood educator.” “She was one of a kind, and everyone knew it.” Ayers’ portrait of BJ brought a response in Ron Jacobs’ Dissident Voice article, “Get Bill Ayers”: “Indeed, the truest hero in the book is the family’s New York child care provider, BJ.”

On Bill’s journey we meet Bernardine’s lawyers Eleanora Kennedy and Michael Kennedy and various other people including Ellie and Robby Meeropol who were Bill’s friends at the University of Michigan. Robby was the son of Ethel and Julius Rosenberg and he was three years old when his parents were executed.

Bernardine and Bill had just adopted Chesa Boudin whose parents, Kathy Boudin and David Gilbert, had been sentenced for murder in the Brinks Robbery in Nyack, New York. Robby explained that there was no road map and that times would be rough for Chesa – honest responses are very much a part of the many vignettes that Ayers presents throughout Public Enemy.

The book depicts seriousness and humor and mostly respect and admiration. There is a story from the early above ground days that I must include in this review.
Leaving swim class one day, we were swept up into a raucous women-led march heading from Broadway and Fifty-ninth Street toward Times Square. "No more porn! No more porn! No more porn!" we chanted ecstatically, fists pumping and voices rising as we entered the pornography district. It was a feisty and colorful crowd, our attendance just a happy accident, but with Zayd cheerfully perched on my shoulders we were in high spirits and quite pleased to be in cahoots. Soon we spotted a pizza stand along the route, and Zayd was famished from swimming and ready for a slice, so we settled into a booth. Zayd reflected on the parade we’d just left: "That was fun," he said. "Why don’t we want more corn?"
Ayers tells the story of all three sons advising him during 2008 and the respect appears to go both ways. Pages 129 to 131 serve as an illustration as Malik, Zayd, and Chesa join Bernardine in coaxing Bill not to speak with the media – a disposition alien to his being. Malik warns him of ambush and it recalls Mailer’s self-admonitions of never talk to the press – they control the story.
The consensus from them, in line with Bernardine’s steady and consistent basic instinct, was that whatever happened on the web or in the press, we should simply turn away. No comment, no elaboration, no clarification, no response. "Be completely quiet," they said, "and stay calm." "It’s harder then it sounds," Zayd added, looking right at me, "especially for you." True, too true: I tend to have a lot on my mind – who doesn’t? – and I’m genetically wired to speak up and speak out, and not always with considered judgment. My default position, no matter what, is to say something… "You’ll get flattened," they now said in unison.
Bill Ayers remained silent through 2008, but of course, “palling around with terrorists” quietly lives on. There is an ethos throughout Public Enemy, consistently present in the ideas, issues, actions, and people portrayed in the book, amidst everything else – this book is homage to Bernardine Dohrn.

Her strength, thoughtfulness, commitment, and humanity is the spirit of Public Enemy: Confessions of An American Dissident. Whether it is gently chiding Bill with their children or being warmly welcomed back by the judge in Chicago when she surfaced from underground – her humanity is ever present. Political commitment is obvious in Dohrn’s first above ground statement: “This is no surrender. The fight against racism and war continues, and I will spend my energy organizing to defeat the American empire.”

Ayers writes of her actions and dispositions when she was imprisoned at the Metropolitan Correctional Center in New York for refusing to give Grand Jury testimony on the Brinks Robbery. The emotion of being away from her kids but at the same time focused political commitment. There is also a great story of her mother passing on contraband when she visited the prison – a chocolate chip cookie!

There is much more to Public Enemy than the samples that I present. Bill Ayers critiques the Weather Underground and provides much more breadth to the ideas, issues, actions, people, and events he portrays. He also pushes his story to the present and therein lies the further message. Ayers, Dohrn, and many of their WO (and beyond) comrades continue to work for the same issues they have pursued beginning in the sixties.

For Ayers it is education and more and the latter includes working with young activists who continue the fight for the end of racism, class disparity, and imperialism. First in the civil rights movement, then SDS and WO, Ayers was part of the “spark” for a just world. His book is a partial story of continuing to keep that “spark” alive today.

One of the ironies of 21st century historical discourse is that despite significantly increased access to information, historical narratives are shaped by economic and political interest and ideology more than ever before.

Widely distributed accounts about iconic political figures such as Dr. Martin Luther King stun those of us who are knowledgeable about the times in which these figures lived. Real historic figures get lionized, sanitized, and most importantly redefined as defenders of the ongoing order rather than activists who committed their lives to revolutionary changes in the economic and political structures that exploit and oppress people.

Most of the media reviews of the life and achievements of Nelson Mandela fit this model.

However, most of my remembrances of Nelson Mandela are different.

First, he committed his life to the cause of creating an economic and political system in his homeland that would provide justice for all people.

Second, Nelson Mandela was part of the great wave of revolutionary anti-colonial leaders who participated in the mass movements for change in the Global South in the 20th century. These movements for independence led to the achievement of liberation for two-thirds of the world’s population from harsh, inhumane white minority rule. The campaign against apartheid in South Africa was part of this anti-colonial struggle.

Mandela shared the vision of such figures as Mahatma Gandhi, Jawaharial Nehru, Kwame Nkrumah, Amical Cabral, Franz Fanon, Fidel Castro, and Che Guevara. These leaders were spokespersons for mass struggles that transformed the world in the 20th century.

Third, Nelson Mandela gave voice and inspiration to young people in the Global North who sought peace and justice in their own societies. Mandela inspired movements that went beyond the struggle against racism and imperialism to address sexism and homophobia as well.

Fourth, Mandela made it clear to many of us (despite sanitized media frames) that he saw himself as part of the movements of people who themselves make history. He worked with all those who shared his vision of a just society: grassroots movements, the South African Communist Party (SACP), the South African labor movement (COSATU), the Black Consciousness Movement, and progressives from faith communities.

To quote from Mandela’s first speech upon release from prison on February 11, 1990:
On this day of my release, I extend my sincere and warmest gratitude to the millions of my compatriots and those in every corner of the globe who have campaigned tirelessly for my release.

I send special greetings to the people of Cape Town, this city which has been my home for three decades. Your mass marches and other forms of struggle have served as a constant source of strength to all political prisoners.

I salute the African National Congress. It has fulfilled our every expectation in its role as leader of the great march to freedom.

I salute our President, Comrade Oliver Tambo, for leading the ANC even under the most difficult circumstances.

I salute the rank and file members of the ANC. You have sacrificed life and limb in the pursuit of the noble cause of our struggle.

I salute combatants of Umkhonto we Sizwe...who have paid the ultimate price for the freedom of all South Africans.

I salute the South African Communist Party for its sterling contribution to the struggle for democracy. You have survived 40 years of unrelenting persecution.

I salute General Secretary Joe Slovo, one of our finest patriots. We are heartened by the fact that the alliance between ourselves and the Party remains as strong as it always was.

I salute the United Democratic Front, the National Education Crisis Committee, the South African Youth Congress, the Transvaal and Natal Indian Congresses and COSATU and the many other formations of the Mass Democratic Movement.

I also salute the Black Sash and the National Union of South African Students. We note with pride that you have acted as the conscience of white South Africa. Even during the darkest days in the history of our struggle you held the flag of liberty high. The large-scale mass mobilisation of the past few years is one of the key factors which led to the opening of the final chapter of our struggle.

I extend my greetings to the working class of our country. Your organised strength is the pride of our movement. You remain the most dependable force in the struggle to end exploitation and oppression...

I pay tribute to the many religious communities who carried the campaign for justice forward when the organisations for our people were silenced...

I pay tribute to the endless heroism of youth, you, the young lions. You, the young lions, have energised our entire struggle.

I pay tribute to the mothers and wives and sisters of our nation. You are the rock-hard foundation of our struggle. Apartheid has inflicted more pain on you than on anyone else.

On this occasion, we thank the world community for their great contribution to the anti-apartheid struggle. Without your support our struggle would not have reached this advanced stage. The sacrifice of the frontline states will be remembered by South Africans forever.
Finally, Nelson Mandela inspired many of us in our own ways to commit to the historical march of people to make a better world. That commitment is powerfully described by a friend, Willie Williamson, a retired teacher from Chicago:
As a young man I learned about Nelson Mandela serving time in prison in South Africa. At that time I was politically ignorant about international affairs, but became curious about the Apartheid racial system because it reminded me so much of the small Mississippi town that I grew up in.

Already angered, after completing a stint in the Vietnam War, I became outraged and somewhat withdrawn. But it was the fight to free Mandela that brought me around to understanding that I had to become a part of a movement with justice at its core. I have Mandela to thank for my understanding of how to relieve an unjust power of its stranglehold. The fight must always be for justice throughout the world!

To say Paul Krassner has lived an eventful life is an understatement. He invented The Realist, America’s premiere counterculture journal. He co-founded the Youth International Party (Yippies). He was a child violin prodigy who, at age six, was the youngest person ever to perform at Carnegie Hall.

He was a member of Ken Kesey’s Merry Pranksters. He edited Lenny Bruce’s classic, How to Talk Dirty and Influence People. He’s written more than a dozen books, recorded several comedy albums, and, at age 80, is still writing, lecturing, and stirring the pot.

Krassner is unique in that he’s one of those veteran radicals who never came in from the cold, never cashed in his chips, and was never co-opted by the mainstream media. This was partly because he didn’t seek their approval, and partly because he wasn’t considered "domesticated" enough to be embraced. As testimony to his wit and sensibilities, he’s the only person to have won both a Playboy magazine satire prize, and a Feminist Party Media Workshop award for journalism.




1. What’s it like being 80 years old?

Well, I’m more aware that it’s one more decade closer to my death, and my priorities keep falling into place. And in order to keep myself, literally, from falling into place -- stemming from a police beating in 1979, when I got caught in a post-verdict riot after covering the trial of Dan White, who was sentenced to seven years for the assassination of San Francisco Mayor George Moscone and Supervisor Harvey Milk -- I now walk around with a cane, and when I go anywhere I use a walker.

Otherwise, I seem to be in good health. I owe my longevity to never taking any legal drugs. Although, I did take an aspirin last month. I didn’t have a headache or anything, it was just at a party, and the host was passing around a plate full of aspirins. It was just a kind of social ingestion. You know, peer pressure.


2. What do you think the result would be if all 50 states legalized marijuana?

Allow me to quote Ken Kesey’s response when I asked, “Do you see the legalization of grass as any sort of panacea?” “The legalization of grass,” he said, “would do absolutely nothing for our standard of living, or our military supremacy, or even our problem of high school dropouts. It could do nothing for this country except mellow it, and that’s not a panacea, that’s downright subversive.


3. How do you feel about Medicare?

It’s worked for me until now. All I know is that my doctor and the doctors of two friends, each with a different doctor, were told that Medicare alone would not be accepted any more. The unstated reason is that an HMO supplement plan will pay the doctor a monthly sum per patient whether or not they come in for medical help. So the doctors and the insurance companies benefit from this plan. And the patient becomes a pawn in the game.


4. Why did you title your memoir Confessions of a Raving, Unconfined Nut?

After Life magazine published a profile of me in 1968, an FBI agent sent a poison-pen letter stating, “To classify Krassner as some sort of social rebel is far too cute. He’s a nut, a raving, unconfined nut.” Even if that were true, it’s not what taxpayers provide funding for the FBI to do. So when I wrote my autobiography, I decided that the agent’s words would serve as a more appropriate title than Yay for Me.


5. The FBI’s tactics during this period are so frightening, they almost defy belief. What was the Bureau’s main beef with you?

I guess they perceived me as a threat to the status quo. But I perceived them as a threat to my life. In 1969, they produced a Wanted poster featuring a large swastika and the headline "LAMPSHADES! LAMPSHADES! LAMPSHADES!" Inside the four square spaces of the swastika were photos of Yippie co-founders Abbie Hoffman, Jerry Rubin and me, and Mark Rudd of SDS. The text warned that “the only solution to Negro problems in America would be the elimination of the Jews. May we suggest the following order of elimination? (After all, we’ve been this way before.) All Jews connected with the Establishment. All Jews connected with Jews connected with the Establishment. All Jews connected with those immediately above. All Jews except those in the Movement. All Jews in the Movement except those who dye their skin black. All Jews (look out, Jerry, Abbie, Mark and Paul)!”

My FBI files indicate that the leaflet was approved by J. Edgar Hoover’s top two aides in Washington D.C.: “Authority was granted to prepare and distribute on an anonymous basis to selected individuals and organizations in the New Left the leaflet submitted. Assure that all necessary precautions are taken to protect the Bureau as the source of these leaflets. NY suggested a leaflet containing pictures of several New Left leaders who are Jewish. This leaflet suggests facetiously the elimination of these leaders. NY’s proposal would create further ill feeling between the New Left and the black nationalist movement.”

And, of course, if some overly militant black nationalist had obtained that flyer and eliminated one of those New Left leaders who was Jewish, the FBI’s bureaucratic ass would be covered. “We said it was a facetious suggestion, didn’t we?”


6. Given that you were at the forefront of the tumultuous Sixties, what comparisons between then and now can you make? How were the Yippies and Occupy movement similar/different?

We had to perform stunts to get media coverage. A group of us went to the New York Stock Exchange and threw $200 worth of singles onto the floor below, where shouts of “Pork Bellies! Pork Bellies!” suddenly morphed into Diving for Dollars. This was followed by a press conference about the connection between capitalism and war. And now, an Occupy placard, “Wall Street Is War Street,” gave me a strong sense of continuity.

The evolution of technology has changed the way protests are organized. The Yippies had to use messy mimeograph machines to print out flyers that had to be folded and stuffed into envelopes, licked, addressed, stamped and mailed. The Internet -- and social media such as Facebook and Twitter -- have enabled Occupiers to inexpensively reach countless people immediately.


7. Despite the obvious limitations of our traditional two-party system, who are some of your all-time favorite and least favorite politicians?

Favorites: Bernie Sanders, Barney Frank, Dennis Kucinich. Least favorites: Ronald Reagan, Richard Nixon, George W. Bush.


8. Obviously, it’s way too early, but if you had to bet $100, who do you see as the Democratic and Republican candidates in 2016? 

Hillary Clinton and Chris Christie.


9. What inspired your infamous FUCK COMMUNISM! poster?

Mad magazine art director and Realist columnist John Francis Putnam wanted to give me a housewarming gift in 1963. He had designed the word FUCK in red-white-and-blue lettering emblazoned with stars and stripes. Now he needed a second word, a noun that would serve as an appropriate object for that verb. He suggested AMERICA, but that didn't seem right to me. It certainly wasn't an accurate representation of my feelings. I was well aware that I probably couldn't publish The Realist in any other country. Besides, a poster saying FUCK AMERICA! lacked a certain sense of irony.

There was at that time a severe anti-Communist hysteria burgeoning throughout the land. The attorney general of Arizona rejected the Communist Party's request for a place on the ballot because state law “prohibits official representation” for Communists and, in addition, “The subversive nature of your organization is even more clearly designated by the fact that you do not even include your Zip Code.”

Alvin Dark, manager of the Giants, announced that “Any pitcher who throws at a batter and deliberately tries to hit him is a Communist.” And singer Pat Boone declared at the Greater New York Anti-Communism Rally in Madison Square Garden, “I would rather see my four daughters shot before my eyes than have them grow up in a Communist United States. I would rather see those kids blown into Heaven than taught into Hell by the Communists.”

So I suggested COMMUNISM for the second word, since the usual correlation between conservatism and prudishness would provide the incongruity that was missing. Putnam designed the word COMMUNISM in red lettering emblazoned with hammers and sickles. Then he presented me with a patriotic poster which now proudly proclaimed FUCK COMMUNISM! -- suitable for framing.


10. Also, I have to ask about your controversial Disneyland Memorial Orgy poster. How did that come about?

When Walt Disney died in December 1966, it occurred to me that he had served as the Creator of this whole stable of imaginary characters who were now mourning in a state of suspended animation. Disney had been their Intelligent Designer, and had repressed all their baser instincts. But now that he had departed, they could finally shed their cumulative inhibitions and participate together in an unspeakable sexual binge to signify the crumbling of an empire.

So, I contacted Wally Wood, who had illustrated the first script I wrote for Mad, and I told him my notion of a memorial orgy at Disneyland. He fulfilled that assignment with a magnificently degenerate montage, unleashing those characters’ collective libido and demystified an entire genre in the process. I published it as a black-and-white two-page centerspread, which was so popular that I re-published it as a poster. In 2005, a new, digitally colored edition of the original artwork in authentic Disney colors (you can see it at paulkrassner.com) was done by a former Disney employee who prefers to remain anonymous.


11. Having done stand-up comedy for more than 50 years, how have your audiences changed?

I think they’re more aware now of the contradictions in mainstream culture, the phony piety that permeates society, the inhumane hypocrisy. And I’ve evolved right along with them. Performing, for me, has always been a two-way street. English is my second language. Laughter is my first.


12. And finally, what are you working on currently?

I'm writing my long-awaited (by me) first novel, about a contemporary Lenny Bruce-type performer. I'm also compiling a collection, The Best of Paul Krassner: 50 Years of Investigative Satire. And I'm gathering up my archives -- translation: all the crap in my garage -- for some lucky university.

AUSTIN -- Cameron McPherson Cunningham was a lawyer nonpareil. Although he succumbed to cancer in July 2012, he will be long remembered in Texas and California, even on the national stage, because he chose to be a lawyer for the people, not for the corporations.

It is not so uncommon now for young lawyers to go into public interest law, or legal services, or even to become radical lawyers, as Bill Kunstler described himself in his memoir. When I was Cam's law partner for the early years in Austin -- 1969 to 1978 -- we both thought of ourselves and self-identified as radical lawyers. As did other partners who came aboard the rollicking ship of our law firm, unlike most all the legal vessels of the time. We meant it to be that way. And I can tell you it was damn good fun in addition to being deadly serious politics.

It all started in Montreat, North Carlolina, in late August or early September 1969. Cam had graduated from the University of Texas Law School in 1967. He received a Reginald Heber Smith fellowship which paid all or part of his salary at a designated legal services program. For him it was the DNA Navajo legal services program, federally funded as part of the War on Poverty, located in the four corners in Arizona. DNA is an acronym for the Navajo phrase Dinébe’iiná Náhiitna be Agha’diit’ahii -- which means “attorneys who work for the economic revitalization of The People."

I had met Cam when he was still in law school and I was with the OEO Regional Office in Austin. (OEO being the federal agency that ran the War on Poverty). Over the next couple of years we became friends. The Movement had galvanized a large segment of young people in the U.S. I opened my solo practice in 1968 and was immediately swamped with cases arising from anti-war demonstrations, the military draft, and civil rights.

In December of 1968 Austin activists, including Martin Wiginton and Greg Calvert, with input from Cam in Arizona, organized a conference of lawyers and Movement people at a dude ranch in Wimberley, Texas, just outside of Austin. The purpose was to nudge fee-charging lawyers into pro bono representation of the multitude of arrestees and military resisters.

As a result of the conference, Cam was “hired” as a roving organizer or liaison with the progressively-inclined lawyers in Texas identified at Wimberley. I doubt that much money for living expenses was ever paid but at some point Cam left the legal services program to take on his new task.

He and his wife, Cris, moved into the rented house where my wife and I lived on the east side of Austin. We became closer friends, so to speak. But we did enjoy the companionship and it was the Sixties. I recall that Cam got a part-time position at the law school with the penal code revision project, in part thanks to law professor and friend, Fred Cohen, known facetiously by other faculty folk as “Fred the Red."

By 1969 Cam was committed to devoting his considerable energies and abilities to Movement law. At summer’s end we got wind of the lawyers’ confab known as the Southern Legal Action Movement (SLAM) to be held at Black Mountain near Montreat, North Carolina. Cam convinced me to go although I had been in informal rehab from the law that summer.

Like Wimberley, the Montreat conference was wild and wooly. All the Movement lawyers we ever heard of were there. From the New York Law Commune we found a model for what Cam wanted to do in Austin: a law commune. And so it was born in the wee hours one night in a long whiskey conversation between the two of us. He had the vision and I at least had some experience in such cases, which did not make me enthusiastic at first. We followed the New York lawyers up to New York after the conference and learned a lot.

Those idealistic principles seem a tad naive now. Like income limitation, legal workers and lawyers all with the same say and voice in the operation, fee cases to pay the way for Movement work, and so on. By the time we got back to Austin I did share Cam’s zeal to proceed with it; he had won me over. We rented a small suite near the University of Texas campus. We had one legal worker, Julie Howell (she is a lawyer now). But it really did not go too well.

Cam was trying to keep the penal code revision job and still practice law. We did defend Richard Chasein at a general court-martial at Fort Hood, after he declined training for riot control in American cities. This was a Movement case we did without fees. Other cases that should have generated fees didn’t. Money was a big problem that fall. I took a job at Dallas Legal Services Project in the spring of 1970. Cam soldiered on. In a few months I returned.

That summer the Radical Lawyers Caucus was formed for a run at the State Bar of Texas convention. With Bill Kunstler as our main speaker and other speeches by Maury Maverick, Jr. and Warren Burnett -- both great progressive Texas lawyers -- we made a splash at the convention. Before the convention the bar’s official journal declined to accept our paid ad about the Radical Lawyers Caucus. The suit we wanted to file was sent to Cam in Austin. I came back in time to brief the law and try the case which we won in federal court.

Our early struggles, stops and starts, changed for the better when a trial lawyer from East Texas contacted us -- or we contacted him after we saw his ad in the Texas Observer. In the fall of 1970 Brady Coleman became the third musketeer and our course was set. For the next couple of years we three were very close. We joked that we were closer to each other than to our wives, which was probably no joke. All three marriages ended in divorce in the early ‘70s.

Brady had a lot of trial experience and he and Cam became a lethal trial team. Cases all around the state sent us into battle: Dallas, Houston, South Texas, and West Texas. Fort Hood kept us hopping. Busts on a large scale happened around the university. Cam was loving the practice of Movement law. He especially took to the criminal law. He and I defended a black activist charged with setting the UT ROTC building on fire.

Cam and Brady tried some murder cases (not political) and we all represented those charged with drugs. Brady and I tried civil cases against the city, police, even one against Ma Bell, the proceeds of which funded a great party that we dubbed the Last Annual Ma Bell Counter-Ripoff Wild Boar Feast.

In 1971 we cleaned out our firm bank account and took off by car to the May Day action in Washington, D.C., where we started out as participants in the action to “shut down D.C.” in protest against the Vietnam war and wound up lawyering to get our comrades out of jail. Later that summer we went to the riotous National Lawyers Guild convention in Boulder, Colorado, where it was decided amid great controversy that legal workers, jail house lawyers, and law students could be members of the previously all-lawyer Guild, the progressive bar association through the decades representing the Movement.

One thing we always did on these trips: have a big old good time. Cam was the leader of this fun, with all of us singing at the top of our lungs, quaffing any available spirits, toking and talking the talk, later recalling the great stories repeatedly even when they made us look bad -- especially when they made us look bad! We were doing exactly what we wanted to do in a time when it counted for more than any other time.

If Cam was the leader of merriment, Brady was the provider of mellow entertainment with his guitar and voice. I tried to crack jokes, often so droll Cam did not recognize the joke and took it literally, as a Midwesterner is wont to do. (He often spoke of growing up in Detroit.) This was the beginning I guess of small rifts between us.

One night sitting at the old Villa Capri Motel dining room in Austin, Cam excoriated both Brady and me for the conventional, sell-out law we had been guilty of prior to coming under his tutelage. It got so bad we all three slammed out of there in different directions. At a time when there was definitely a bit of tension, we were saved again by adding legal ballast to the firm. We were lucky enough to gain two great new partners, Bobby Nelson and John Howard in fall 1972 at the old 15th Street law office. And soon we were back to doing what we set out to do, representing the Movement.

In 1972 Cam and Brady were part of the legal team that represented the Vietnam Veterans Against the War (VVAW) in a trial in Gainesville, Florida. The Gainseville 8 were charged with conspiring to blow up the Republican convention. In 1974 John Howard and I represented a defendant in the Wounded Knee occupation (as we might call it now). There had been a siege of 71 days to a standoff with blazing guns. The Indians and their allies who held the store against the FBI were charged with multiple felonies in federal court.

I am unsure of the year, but in that same period, Bobby Nelson was part of a delegation to Cuba. We all had our Movement cases in and around Austin involving defense of GI’s, SDS members, civil rights activists, lawsuits concerning women’s rights, gay rights, and the counterculture in myriad legal battles. The law firm was an institution in the community of Movement groups and people from that Montreat beginning -- Cam’s vision and determination -- to the end of the firm in 1977, the year Cam moved to the Bay Area of California.
