Stephanie Smith was pretty much committed to vegetarianism. But after her mother insisted she get a little protein from a traditional meal, she broke down and let her mother (Sharon) cook her a burger. Sharon slapped a Sam’s Club beef patty in the frying pan and they had their American style meal.

When Stephanie got sick, her mother was sure she knew what had caused it. It had to be the spinach. What neither of them knew was that the meat industry poisons people all the time. That’s why it rarely makes the news. Stephanie went into seizures and had to be put into a coma to save her life. Today she is recovering, but she will probably never walk again.

The story of the burger that poisoned her is a complex one. No, as you probably have already guessed, the cows (as opposed to steers) who supplied the meat for that burger were not raised on a family farm. If the cows had been raised in this traditional manner, they would have been grass fed, allowed to exercise and slaughtered in a clean environment.

As it was the killer burger came from multiple sources. To maximize profits, Cargill purchased cow meat from here and there, high intensity feedlots where cattle are penned in and pumped full of the high protein food (soy) that makes their meat attractive on the plate. After feeding out in these filthy crowded lots, the animals are brought in to be slaughtered in an assembly line process. Although there are safety rules, greed and the sheer impossibility of keeping feces off the future meat products make food safety in this environment extremely difficult to achieve.

No one knows exactly where the E. coli tainted meat came from. Could be Omaha. Could be Uruguay. All the different sources make it easy for the companies to blame each other, while they speed up production and hire illegal immigrants at lower wages. The American Meat Institute says it is doing what it can to slow down the rate of E. coli poisoning.

Cook your burger all the way through and you will kill the pathogens, diseased tissue and possibly some of the hormones and antibiotics. Then you will have a wholesome American style meal. Medium rare could quite possibly kill you. Meat promoters point to the need for total irradiation of meat products. Just another part of a mouth watering American food experience, I guess, but obviously another workplace hazard for the largely immigrant workforce.

Are there other options? Aside from the obvious vegetarian diet that feeds the world 15X over compared to meat eating? The vegetable diet that is better for your health? The diet that does more to stop global warming than driving an electric car, riding a bicycle and recycling 100% of your trash? The diet that allows humanity to live at peace with animals and each other? Not that diet?

Okay, the other alternative is to go to your butcher and have him (or her) cut and grind up a piece of animal flesh for you to eat. It won’t cost $1 a pound and come in a pre formed patty, but it will put you in a safer and more morally honest position as a meat eater.

Food Safety Meets Organic Farming: Destroying the Conceptual Foundations by Hyper-Technologizing

Crops, ponds destroyed in quest for food safety

Washington -- Dick Peixoto planted hedges of fennel and flowering cilantro around his organic vegetable fields in the Pajaro Valley near Watsonville to harbor beneficial insects, an alternative to pesticides.

He has since ripped out such plants in the name of food safety, because his big customers demand sterile buffers around his crops. No vegetation. No water. No wildlife of any kind.

"I was driving by a field where a squirrel fed off the end of the field, and so 30 feet in we had to destroy the crop," he said. "On one field where a deer walked through, didn't eat anything, just walked through and you could see the tracks, we had to take out 30 feet on each side of the tracks and annihilate the crop."

In the verdant farmland surrounding Monterey Bay, a national marine sanctuary and one of the world's biological jewels, scorched-earth strategies are being imposed on hundreds of thousands of acres in the quest for an antiseptic field of greens. And the scheme is about to go national.

Invisible to a public that sees only the headlines of the latest food-safety scare - spinach, peppers and now cookie dough - ponds are being poisoned and bulldozed. Vegetation harboring pollinators and filtering storm runoff is being cleared. Fences and poison baits line wildlife corridors. Birds, frogs, mice and deer - and anything that shelters them - are caught in a raging battle in the Salinas Valley against E. coli O157:H7, a lethal, food-borne bacteria.

In pending legislation and in proposed federal regulations, the push for food safety butts up against the movement toward biologically diverse farming methods, while evidence suggests that industrial agriculture may be the bigger culprit.

'Foolhardy' approach

"Sanitizing American agriculture, aside from being impossible, is foolhardy," said UC Berkeley food guru Michael Pollan, who most recently made his case for smaller-scale farming in the documentary film "Food, Inc." "You have to think about what's the logical end point of looking at food this way. It's food grown indoors hydroponically."

Scientists do not know how the killer E. coli pathogen, which dwells mainly in the guts of cattle, made its way to a spinach field near San Juan Bautista (San Benito County) in 2006, leaving four people dead, 35 with acute kidney failure and 103 hospitalized.

The deadly bug first appeared in hamburger meat in the early 1980s and migrated to certain kinds of produce, mainly lettuce and other leafy greens that are cut, mixed and bagged for the convenience of supermarket shoppers. Hundreds of thousands of the bug can fit on the head of a pin; as few as 10 can lodge in a salad and end in lifelong disability, including organ failure.

Going national

For many giant food retailers, the choice between a dead pond and a dead child is no choice at all. Industry has paid more than $100 million in court settlements and verdicts in spinach and lettuce lawsuits, a fraction of the lost sales involved.

Galvanized by the spinach disaster, large growers instituted a quasi-governmental program of new protocols for growing greens safely, called the "leafy greens marketing agreement." A proposal was submitted last month in Washington to take these rules nationwide.

A food safety bill sponsored by Rep. Henry Waxman, D-Los Angeles, passed this month in the House Energy and Commerce Committee. It would give new powers to the Food and Drug Administration to regulate all farms and produce in an attempt to fix the problem. The bill would require consideration of farm diversity and environmental rules, but would leave much to the FDA.

An Amish farmer in Ohio who uses horses to plow his fields could find himself caught in a net aimed 2,000 miles away at a feral pig in San Benito County. While he may pick, pack and sell his greens in one day because he does not refrigerate, the bagged lettuce trucked from Salinas with a 17-day shelf life may be considered safer.

The leafy-green agreement is based on available science, but it is just a jumping-off point.

Large produce buyers have compiled secret "super metrics" that go much further. Farmers must follow them if they expect to sell their crops. These can include vast bare-dirt buffers, elimination of wildlife, and strict rules on water sources. To enforce these rules, retail buyers have sent forth armies of food-safety auditors, many of them trained in indoor processing plants, to inspect fields.

Keeping children out

"They're used to working inside the factory walls," said Ken Kimes, owner of New Natives farms in Aptos (Santa Cruz County) and a board member of the Community Alliance With Family Farmers, a California group. "If they're not prepared for the farm landscape, it can come as quite a shock to them. Some of this stuff that they want, you just can't actually do."

Auditors have told Kimes that no children younger than 5 can be allowed on his farm for fear of diapers. He has been asked to issue identification badges to all visitors.

Not only do the rules conflict with organic and environmental standards; many are simply unscientific. Surprisingly little is known about how E. coli is transmitted from cow to table.

Reducing E. coli

Scientists have created a vaccine to reduce E. coli in livestock, and a White House working group announced plans Tuesday to boost safety standards for eggs and meat. This month, the group is expected to issue draft guidelines for reducing E. coli contamination in leafy greens, tomatoes and melons.

Some science suggests that removing vegetation near field crops could make food less safe. Vegetation and wetlands are a landscape's lungs and kidneys, filtering out not just fertilizers, sediments and pesticides, but also pathogens. UC Davis scientists found that vegetation buffers can remove as much as 98 percent of E. coli from surface water. UC Davis advisers warn that some rodents prefer cleared areas.

Produce buyers compete to demand the most draconian standards, said Jo Ann Baumgartner, head of the Wild Farm Alliance in Watsonville, so that they can sell their products as the "safest."

State agencies responsible for California's water, air and wildlife have been unable to find out from buyers what they are demanding.

They do know that trees have been bulldozed along the riparian corridors of the Salinas Valley, while poison-filled tubes targeting rodents dot lettuce fields. Dying rodents have led to deaths of owls and hawks that naturally control rodents.

Unscientific approach

"It's all based on panic and fear, and the science is not there," said Dr. Andy Gordus, an environmental scientist with the California Department of Fish and Game.

Preliminary results released in April from a two-year study by the state wildlife agency, UC Davis and the U.S. Department of Agriculture found that less than one-half of 1 percent of 866 wild animals tested positive for E. coli O157:H7 in Central California.

Frogs are unrelated to E. coli, but their remains in bags of mechanically harvested greens are unsightly, Gordus said, so "the industry has been using food safety as a premise to eliminate frogs."

Farmers are told that ponds used to recycle irrigation water are unsafe. So they bulldoze the ponds and pump more groundwater, opening more of the aquifer to saltwater intrusion, said Jill Wilson, an environmental scientist at the Central Coast Regional Water Quality Control Board in San Luis Obispo.

Wilson said demands for 450-foot dirt buffers remove the agency's chief means of preventing pollution from entering streams and rivers. Jovita Pajarillo, associate director of the water division in the San Francisco office of the Environmental Protection Agency, said removal of vegetative buffers threatens Arroyo Seco, one of the last remaining stretches of habitat for steelhead trout.

Turning down clients

"It's been a problem for us trying to balance the organic growing methods with the food safety requirements," Peixoto said. "At some point, we can't really meet their criteria. We just tell them that's all we can do, and we have to turn down that customer."

Large retailers did not respond to requests for comment. Food trade groups in Washington suggested calling other trade groups, which didn't comment.

Chiquita/Fresh Express, a large Salinas produce handler, told the advocacy group Food and Water Watch that the company has "developed extensive additional guidelines for the procurement of leafy greens and other produce, but we consider such guidelines to be our confidential and proprietary information."

Seattle trial lawyer Bill Marler, who represented many of the plaintiffs in the 2006 E. coli outbreak in spinach, said, "If we want to have bagged spinach and lettuce available 24/7, 12 months of the year, it comes with costs."

Still, he said, the industry rules won't stop lawsuits or eliminate the risk of processed greens cut in fields, mingled in large baths, put in bags that must be chilled from packing plant to kitchen, and shipped thousands of miles away.

"In 16 years of handling nearly every major food-borne illness outbreak in America, I can tell you I've never had a case where it's been linked to a farmers' market," Marler said.

"Could it happen? Absolutely. But the big problem has been the mass-produced product. What you're seeing is this rub between trying to make it as clean as possible so they don't poison anybody, but still not wanting to come to the reality that it may be the industrialized process that's making it all so risky."

Some major recent outbreaks of food-borne illness

The Food and Drug Administration lists 40 food-borne pathogens. Among the more common: E-coli O157:H7, salmonella, listeria, campylobacter, botulism and hepatitis A.

June 2009: E. coli O157:H7 found in Nestle Toll House refrigerated cookie dough manufactured in Danville, Va., resulted in the recall of 3.6 million packages. Seventy-two people in 30 states were sickened. No traces found on equipment or workers; investigators are looking at flour and other ingredients.

October 2008: Salmonella found in peanut butter from a Peanut Corp. of America plant in Georgia. Nine people died, and an estimated 22,500 were sickened. Criminal negligence was alleged after the product tested positive and was shipped.

June 2008: Salmonella Saintpaul traced to serrano peppers grown in Mexico. More than 1,000 people were sickened in 41 states, with 203 reported hospitalizations and at least one death. Tomatoes were suspected, devastating growers.

April 2007: E. coli O157:H7 found in beef, sickening 14 people. United Food Group recalled 5.7 million pounds of meat.

December 2006: E. coli O157:H7 traced to Taco Bell restaurants in New Jersey and Long Island, N.Y. Green onions suspected, then lettuce. Thirty-nine people were sickened, some with acute kidney failure.

September 2006: E. coli O157:H7 found in Dole bagged spinach processed at Earthbound Farms in San Juan Bautista (San Benito County). The outbreak killed four people, sent 103 to hospitals, and devastated the spinach industry.

More About MRSA and Agribusiness

This is a follow-up to an article we posted a few days ago. The big news here is the potential connection between the development of debilitating (even deadly) antibiotic-resistant pathogens and the use of antibiotics in animal feed. Let's press for more active research to determine if this might be true.

Pathogens in Our Pork

We don’t add antibiotics to baby food and Cocoa Puffs so that children get fewer ear infections. That’s because we understand that the overuse of antibiotics is already creating “superbugs” resistant to medication.

Yet we continue to allow agribusiness companies to add antibiotics to animal feed so that piglets stay healthy and don’t get ear infections. Seventy percent of all antibiotics in the United States go to healthy livestock, according to a careful study by the Union of Concerned Scientists — and that’s one reason we’re seeing the rise of pathogens that defy antibiotics.

These dangerous pathogens are now even in our food supply. Five out of 90 samples of retail pork in Louisiana tested positive for MRSA — an antibiotic-resistant staph infection — according to a peer-reviewed study published in Applied and Environmental Microbiology last year. And a recent study of retail meats in the Washington, D.C., area found MRSA in one pork sample, out of 300, according to Jianghong Meng, the University of Maryland scholar who conducted the study.

Regardless of whether the bacteria came from the pigs or from humans who handled the meat, the results should sound an alarm bell, for MRSA already kills more than 18,000 Americans annually, more than AIDS does.

MRSA (pronounced “mersa”) stands for methicillin-resistant Staphylococcus aureus. People often get it from hospitals, but as I wrote in my last column, a new strain called ST398 is emerging and seems to find a reservoir in modern hog farms. Research by Peter Davies of the University of Minnesota suggests that 25 percent to 39 percent of American hogs carry MRSA.

Public health experts worry that pigs could pass on the infection by direct contact with their handlers, through their wastes leaking into ground water (one study has already found antibiotic-resistant bacteria entering ground water from hog farms), or through their meat, though there has been no proven case of someone getting it from eating pork. Thorough cooking will kill the bacteria, but people often use the same knife to cut raw meat and then to chop vegetables. Or they plop a pork chop on a plate, cook it and then contaminate it by putting it back on the original plate.

Yet the central problem here isn’t pigs, it’s humans. Unlike Europe and even South Korea, the United States still bows to agribusiness interests by permitting the nontherapeutic use of antibiotics in animal feed. That’s unconscionable.

The peer-reviewed Medical Clinics of North America concluded last year that antibiotics in livestock feed were “a major component” in the rise in antibiotic resistance. The article said that more antibiotics were fed to animals in North Carolina alone than were administered to the nation’s entire human population.

“We don’t give antibiotics to healthy humans,” said Robert Martin, who led a Pew Commission on industrial farming that examined antibiotic use. “So why give them to healthy animals just so we can keep them in crowded and unsanitary conditions?”

The answer is simple: politics.

Legislation to ban the nontherapeutic use of antibiotics in agriculture has always been blocked by agribusiness interests. Louise Slaughter of New York, who is the sole microbiologist in the House of Representatives, said she planned to reintroduce the legislation this coming week.

“We’re losing the ability to treat humans,” she said. “We have misused one of the best scientific products we’ve had.”

That’s an almost universal view in the public health world. The Infectious Diseases Society of America has declared antibiotic resistance a “public health crisis” and recounts the story of Rebecca Lohsen, a 17-year-old New Jersey girl who died from MRSA in 2006. She came down with what she thought was a sore throat, endured months in the hospital, and finally died because the microbes were stronger than the drugs.

This will be an important test for President Obama and his agriculture secretary, Tom Vilsack. Traditionally, the Agriculture Department has functioned mostly as a protector of agribusiness interests, but Mr. Obama and Mr. Vilsack have both said all the right things about looking after eaters as well as producers.

So Mr. Obama and Mr. Vilsack, will you line up to curb the use of antibiotics in raising American livestock? That is evidence of an industrial farming system that is broken: for the sake of faster-growing hogs, we’re empowering microbes that endanger our food supply and threaten our lives.

MRSA: A Potential Cost of Industrial Agriculture

Our Pigs, Our Food, Our Health

The late Tom Anderson, the family doctor in this little farm town in northwestern Indiana, at first was puzzled, then frightened.

He began seeing strange rashes on his patients, starting more than a year ago. They began as innocuous bumps — “pimples from hell,” he called them — and quickly became lesions as big as saucers, fiery red and agonizing to touch.

They could be anywhere, but were most common on the face, armpits, knees and buttocks. Dr. Anderson took cultures and sent them off to a lab, which reported that they were MRSA, or staph infections that are resistant to antibiotics.

MRSA (methicillin-resistant Staphylococcus aureus) sometimes arouses terrifying headlines as a “superbug” or “flesh-eating bacteria.” The best-known strain is found in hospitals, where it has been seen regularly since the 1990s, but more recently different strains also have been passed among high school and college athletes. The federal Centers for Disease Control and Prevention reported that by 2005, MRSA was killing more than 18,000 Americans a year, more than AIDS.

Dr. Anderson at first couldn’t figure out why he was seeing patient after patient with MRSA in a small Indiana town. And then he began to wonder about all the hog farms outside of town. Could the pigs be incubating and spreading the disease?

“Tom was very concerned with what he was seeing,” recalls his widow, Cindi Anderson. “Tom said he felt the MRSA was at phenomenal levels.”

By last fall, Dr. Anderson was ready to be a whistle-blower, and he agreed to welcome me on a reporting visit and go on the record with his suspicions. That was a bold move, for any insinuation that the hog industry harms public health was sure to outrage many neighbors.

So I made plans to come here and visit Dr. Anderson in his practice. And then, very abruptly, Dr. Anderson died at the age of 54.

There was no autopsy, but a blood test suggested a heart attack or aneurysm. Dr. Anderson had himself suffered at least three bouts of MRSA, and a Dutch journal has linked swine-carried MRSA to dangerous human heart inflammation.

The larger question is whether we as a nation have moved to a model of agriculture that produces cheap bacon but risks the health of all of us. And the evidence, while far from conclusive, is growing that the answer is yes.

A few caveats: The uncertainties are huge, partly because our surveillance system is wretched (the cases here in Camden were never reported to the health authorities). The vast majority of pork is safe, and there is no proven case of transmission of MRSA from eating pork. I’ll still offer my kids B.L.T.’s — but I’ll scrub my hands carefully after handling raw pork.

Let me also be very clear that I’m not against hog farmers. I grew up on a farm outside Yamhill, Ore., and was a state officer of the Future Farmers of America; we raised pigs for a time, including a sow named Brunhilda with such a strong personality that I remember her better than some of my high school dates.

One of the first clues that pigs could infect people with MRSA came in the Netherlands in 2004, when a young woman tested positive for a new strain of MRSA, called ST398. The family lived on a farm, so public health authorities swept in — and found that three family members, three co-workers and 8 of 10 pigs tested all carried MRSA.

Since then, that strain of MRSA has spread rapidly through the Netherlands — especially in swine-producing areas. A small Dutch study found pig farmers there were 760 times more likely than the general population to carry MRSA (without necessarily showing symptoms), and Scientific American reports that this strain of MRSA has turned up in 12 percent of Dutch retail pork samples.

Now this same strain of MRSA has also been found in the United States. A new study by Tara Smith, a University of Iowa epidemiologist, found that 45 percent of pig farmers she sampled carried MRSA, as did 49 percent of the hogs tested.

The study was small, and much more investigation is necessary. Yet it might shed light on the surge in rashes in the now vacant doctor’s office here in Camden. Linda Barnard, who was Dr. Anderson’s assistant, thinks that perhaps 50 people came in to be treated for MRSA, in a town with a population of a bit more than 500. Indeed, during my visit, Dr. Anderson’s 13-year-old daughter, Lily, showed me a MRSA rash inflaming her knee.

“I’ve had it many times,” she said.

So what’s going on here, and where do these antibiotic-resistant infections come from? Probably from the routine use — make that the insane overuse — of antibiotics in livestock feed. This is a system that may help breed virulent “superbugs” that pose a public health threat to us all. That’ll be the focus of my next column, on Sunday.

The Rogues' Gallery of Food Awards

The main award goes to China for the sheer number of melamine-tainted products it manufactured and distributed, and if it was up to me to distribute real food awards (an institution that is sorely needed, IMHO), they'd be the recipients of quite a few more. I sincerely hope China will learn the many, many food safety lessons and review the entirety of their food production lines in a clear and verifiable manner if they want to entice the rest of the world with their foodstuffs. For now, I'm not advocating anyone to purchase any edibles made in China. It will change in due course.

China is not alone in my books. Case in point: Centers for Disease Control and Prevention says that last year 76 million Americans were struck by food-borne illnesses, and more than 300,000 were hospitalized. Sadly about 5,000 each year succumb to microbial infections.

Best Meat Recall Award: Hallmark/Westland Meat Packing of California agreed to take back more than 143 million pounds of raw and frozen meat when it was found in violation of inspection rules.

Stupidest Food Product (since recalled) Award: Cambrooke Foods® makes "Low Protein Imitation Cream Cheese products in the vain hope that it might fool people into buying it. Because of possible health risks they have recalled as a precaution because some of their products may be contaminated with Listeria monocytogenes, an organism which can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems. Although healthy individuals may suffer only short-term symptoms such as high fever, severe headache, stiffness, nausea, abdominal pain and diarrhea, Listeria infection can cause miscarriages and stillbirths among pregnant women.

Best Villain: not enough has been written about the evils of high-fructose corn syrup:

High-fructose corn syrup is a common sweetener and preservative. High-fructose corn syrup is made by changing the sugar (glucose) in cornstarch to fructose - another form of sugar. The end product is a combination of fructose and glucose. Because it extends the shelf life of processed foods and is cheaper than sugar, high-fructose corn syrup has become a popular ingredient in many sodas, fruit-flavored drinks and other processed foods.

To sum it up colas have truckloads of sugar and hardly any nutrients and may contain caffeine, an addictive drug. And it bloats your body with chemicals.

Consistency Category Award: a perennial food bandit is a packet of sour cream and onion potato chips. The damage: 150 calories for a dozen chips, 10 g fat (of which 3 g is saturated), and a ghastly 210 mg sodium! Empty calories to boot with extra trans-fats and a dash of MSG.

Worst Supporting Category Award: the most common form of bread in America is the mass-produced white, soft doughy bread in plastic bags with a long shelf life. Look at the ingredients in an average packaged white bread and you will see that it contains flour plus sugar, corn syrup (again) and a dozen other ingredients. True bread is simply flour and water with a pinch of salt and yeast. Stick to your local baker, that is if they still exist in your neighborhood!

Special Award for Underhandedness: what Kellogg's does not want you to know: the company touts that its Special K Fruit & Yogurt cereal combines the crunch of whole grain goodness, the smooth creaminess of yogurt and the sweet taste of berries. Yeah, right! There is more refined rice than whole grain wheat, no berries (just dyed apple pieces), and no yogurt (just yogurt powder that is usually heat treated, killing any beneficial bacteria) in the cereal. And while I'm the Kellogg's case, I might as well inform you that their "Kellogg's Eggo Nutri-Grain Pancakes" is bereft of either "Made with Whole Wheat and Whole Grain" but consist primarily of white flour. Moving along.

Supporting Make-up Award: Anyone for chocolate-laden doughnuts? Consider this then: per unit you get to eat 300 calories, 19 g fat (of which 6 g is saturated). All doughnuts are high in trans-fats, sugar and are extremely calorific. Supermarket versions are the worst!

Sneakiness Award: if you thought that McDonald's Chicken Selects Premium Breast Strips sound healthy, you're in for a surprise: ounce for ounce, the Selects are no healthier than the chain's Chicken McNuggets. A standard, five-strip order has 670 calories and 10 grams of artery-clogging fat. That's about the same as a Big Mac, but the burger has 1,040 mg of sodium, while the Selects hit 1,660 mg!

Best Disguise Award: another calorific horror story is the Chipotle Chicken Burrito (tortilla, rice, pinto beans, cheese, chicken, sour cream, and salsa) It combines a whopping 1,040 calories and 16½ grams of saturated fat in one serving and the burrito is loaded with 2,500 mg of sodium!

Best Fantasy Story Award: EnvigaCoca-Cola/Nestle claims that their new drink combination of caffeine and an antioxidant extracted from green tea will cause people to burn more calories than the drink provides and help them control their weight. In fact, one in five people drinking Enviga burn fewer, not more, calories and long-term studies on the ingredients show no consistent effect on weight. ole!

The Real Melamine Story : The FDA Isn't Protecting Us

It's been more than a year and a half since the Chinese melamine story first landed in the U.S. press, but the ripple effects continue to spread. Three months ago, the contaminant showed up in baby formula. (The earlier scare was limited to pet food.) In the last couple of weeks, we've learned that China is now investigating more than two dozen cases of animal feed contaminated with melamine, and its health officials have identified 17 other illegal food additives that demand scrutiny—including boric acid and Sudan Red dye.

The U.S. Department of Agriculture has now resorted to random spot checks of hot dogs, chicken nuggets, frozen pizzas, and other foods processed with milk powder, and scientific organizations are discussing better ways to detect melamine in the global food supply. From the looks of it, this sprawling scandal will be with us for some time.

The deepening severity of the problem stands in sharp contrast to the continued insouciance of the Food and Drug Administration. When Canada voiced concern over milk-powder imports from the United States in late September, an FDA spokeswoman gave a dismissive response: "The public health crisis is in China." When, over the next several weeks, the administration finally discovered melamine in baby formula sold here in the United States, its first order of business was to set up a conference call to warn the companies that produce 90 percent of the world's milk powder—Abbott Labs, Mead Johnson, and Nestlé. But when it came to the general public, the FDA remained silent—at least until the Associated Press filed a Freedom of Information Act request for the test results and published the news in late November. The Department of Agriculture declared (PDF) that it will follow the lead of the FDA on the melamine issue, which is why it's only just now begun to take action.

Conscientious consumers who have followed the melamine story are appropriately outraged. Some have written off the FDA as hopelessly corrupt and proposed that we all protect ourselves by eating locally grown food. But self-imposed culinary isolationism isn't going to solve this problem. Once milk power enters the nation's commercial bloodstream, it's difficult to avoid. The powder appears in a dizzying array of products—caramelized candies, whey protein supplements, power bars, powdered drinks, nondairy creamers, and baking mixes, among others. We don't have to persuade every American to avoid every one of these products. Instead, let's fix some of the obvious flaws with the FDA so the agency can start doing what it's supposed to do.

Over the course of the scandal, the government made three major mistakes. All of these have become part of the FDA's standard operating procedure, and each could be remedied with proper legislative action. The first involves the arbitrary adjustment of allowable levels of a contaminant. On Nov. 26, the agency confessed on its Web site to being "currently unable to establish any level of melamine and melamine-related compounds in infant formula that does not raise public health concerns." A day later, just after the milk-powder news hit CNN, Dr. Stephen Sundlof, head of the FDA's Center for Food Safety, described the baby formula results as "in the trace range, and from a public health or infant health perspective, we consider those to be perfectly fine." (The administration made a similarly arbitrary decision a few weeks ago concerning mercury levels in seafood.) Melamine is an adulterant. How can it go from being unsafe one day to being "perfectly fine" the next? If the FDA cannot answer this question—that is, if it has no scientific evidence to justify the flip-flop—the change should not be legally permissible.

The second mistake is to use the risk of acute poisoning as a reference for setting contaminant standards. There is a long tradition of business-friendly regulatory agencies avoiding reference to studies of chronic exposure when setting legal trace limits. The Department of Agriculture, for example, ignored long-term effects when it set fruit-residue limits for arsenic-based insecticides in the 1930s. The situation with melamine has been no different. Legal limits in food other than infant formula sit at 2.5 parts per million, a rate that is by most accounts relatively safe with respect to acute toxicity. As a toxicologist at the Minnesota Department of Public Health recently told me, however, there's not a single study out there on the impact of long-term, low-dose exposure to melamine. Meanwhile, we have seen a mysterious but dramatic increase in kidney stones among children and young adults. Medical doctors are largely confused about the underlying cause and more often than not blame obesity. But melamine is known to cause kidney problems like these, and long-term exposure could be responsible for the larger trend. In that case, the FDA would be forced to reduce allowable trace amounts to zero—which is exactly where they should be until studies of chronic exposure suggest otherwise.

A third mistake has to do with the FDA's tendency to regulate finished products at the expense of raw materials. By choosing to monitor the safety of imported food items instead of the ingredients that go into them, the FDA not only ignores the intricate nature of global food production but opens the door for Chinese wheat gluten, rice gluten, and milk powder to enter the U.S. food supply without the benefit of stringent regulation. To make matters worse, our so-called "country of origin" labeling laws don't apply to individual ingredients in packaged food products. It might seem unwieldy to require a separate label for each foreign ingredient in a can of soup, but the inconvenience would force the FDA to protect our food supply at its most vulnerable points.

These are grave problems, but there's an achievable regulatory solution for each of them. If the FDA were required by law to provide scientific evidence when it changes adulterant standards and to rely on studies of both acute and chronic toxicity when it set those standards, it would be far more difficult for the bureaucrats to coddle corporate concerns. Add to that a requirement for country-of-origin labeling for all imported foodstuffs, and we're more likely to escape major health scares like this in the future. Short of becoming a nation of locavores in a globalized world, that may be the best we can do.
